            1. GENERAL INFORMATION

            These general terms of use ("General terms") regulate the use of the official Parmigiano-Reggiano Cheese Consortium website ("Website"), which can be accessed through the main address www.parmigianoreggiano.com, as well as through the URL address www.parmigianoreggiano.com/it, or through any other addresses that enable direct access to sections or pages of the Website.

            2. PURPOSE

            Through this Website, users have access to and may use the various contents and services made available by the Consortium.

            The Website is designed to provide visitors and users with institutional, general and technical information on the Consortium's activity, which is aimed at protecting, promoting and supervising the Protected Designation of Origin Parmigiano-Reggiano, and at safeguarding consumers, in every stage of production and sale of the cheese for which use of the designation is permitted.

            3. INTELLECTUAL PROPERTY

            **Protected Designation of Origin, trademarks and distinctive marks **

            The name Parmigiano-Reggiano, which appears constantly in this Website, is a Protected Designation of Origin pursuant to the provisions of Regulation (EU)1151/2012 , on the Protection of geographical indications and designation of origin of agricultural and food products. Accordingly, the Consortium is the sole, exclusive owner of this designation, which may only be used by producers operating in the production area and in accordance with the conditions described in the production specifications ("Specifications").

            Therefore, use of the designation, in particular usurpation, imitation or evocation thereof, for products not complying with the Specifications is prohibited, even if the designation is translated or accompanied by expressions such as "kind", "type", "method" or similar terms, unless prior, written, express consent has been obtained from the Consortium.

            The Parmigiano-Reggiano designation, along with other distinctive marks (logos and terms) appearing in this Website, is protected by current national, European and international laws on trademarks and intellectual property. These distinctive marks are the exclusive property of the Consortium, therefore their use on the market is absolutely prohibited without prior, written, express authorisation by the Consortium. The same prohibition extends to marks that may be confused with said distinctive marks.

            Domain names

            As pointed out in the previous paragraph with respect to the Protected Designation of Origin Parmigiano-Reggiano and to the other distinctive marks, the domain name www.parmigianoreggiano.com and any other domain that enables direct or indirect access to this Website, among which www.parmigianoreggiano.com/it, are the exclusive property of the Consortium. Illegitimate use is a violation of property rights and shall be prosecuted to the full extent of current national and international laws.

            Copyright

            The contents, texts, pictures, drawings, logos, images, sounds, videos, animations, recordings, software, programme codes, games and, in general, any intellectual creation and/or property appearing in this Website, as well as the Website itself as a multimedia product, are protected by current regulations on copyright and intellectual property.

            The Consortium holds exclusive rights over the reproduction, dissemination, distribution, modification and translation, as well as any other property right, on the contents indicated in the above paragraph.

            In certain cases, the Consortium has been duly authorised to use specific contents by their legitimate owners.

            All of the above is subject to the moral rights of the authors in accordance with current copyright and intellectual property regulations.

            6. APPLICABLE LAW AND JURISDICTION

            These General Terms are governed by Italian law.

            Any dispute arising out of the relationship with the Consortium's website, or out of the interpretation and/or application of these General Terms shall be subject to Italian laws, with the exclusive jurisdiction of the Court of Bologna, with the parties expressly waiving any other jurisdiction , except in the case of disputes involving a consumer user, in which case the court of jurisdiction shall be the one in the place of residence or elected domicile of the latter.
